Permitted Alterations Effective July 1st 2018

Permitted Alterations that Require a Section 98 Form:

Section 98 of the Condominium Act, 1998, (the “Act”) requires that for a unit owner to make any addition, alteration or improvement (hereafter, an “improvement”) to the common elements, the improvement must be:

a. approved by the board of directors of the condominium;
b. consistent with the provisions of the Act and the declaration of the condominium; and
c. the subject of an agreement entered into by the condominium corporation and the unit owner and the agreement must be registered on title to the owner’s unit.
These are not optional conditions. The failure to comply with any one of them renders the unit owner’s improvement to the common elements illegal.
Therefore, the first things to know about section 98 agreements are that where an owner makes any change to the common elements, such agreement must be in place and must be registered on title to the owner’s unit.

Skylights

  • Skylights limited to a maximum size of 24” x 48”
  • Sola tube type mini skylights allowed
  • Installation maintenance and repairs responsibility of the owner
  • Installation must be done by professional contractor with expertise with skylights

Patio Extension

  • Extension of rear patios to fence line only
  • Wood decks installed over patio stones

Irrigation Systems

  • Individual irrigation systems installed by a licensed professional contractor

Awnings

  • Awnings over rear patio or rear decks, installed by professional contractor

French Doors

  • Change a sliding door entrance to a French style door, in front or rear of unit.

Satellite Dish

  • Mounting of dish restricted to the rear of house only
  • Mounted must be on the wall of chimney chase.
  • No mounting allowed on roof.

EV Charging Station

  • To be installed in the garage only
  • Must be installed by a licensed electrician

Permitted Alterations Effective July 1st 2018

Alterations, NOT requiring a Section 98 form:

Screen Doors

  • To be installed in accordance with specification sheet provided by PCC306
  • Installation will be done by professional contractor
  • Phantom screen doors allowed.

Mailboxes

  • Allowed one mounted near garage man door entrance

Personal Landscaping Front

  • Within the courtyard, front flowerbed, and next to walkway to front door.
  • Planting allowed on driveway planter boxes
  • Hanging planters at front fence entrance area only
  • NO planting allowed around the base of the tree in front of the home.

Personal Landscaping Rear

  • Planter boxes and beds along rear patio, deck, and rear fence
  • Hanging planters
  • Bird feeder or any wild animal feeder NOT allowed.

Lighting & Security

  • Motion sensor, security camera, or lights at rear patio, front walkway, or front entrance area
  • Garden lighting, additional lighting next to garage.
  • All lighting must be CSA approved and installed by a professional contractor.
  • Cameras must be for security only, and be focused on entry areas.

Air Conditioners

  • Can be moved to a different location but must stay at the rear of the unit.

Gas Fireplaces

  • Gas fireplaces allowed, installed by a licensed gas contractor.

Front Doors

  • All front doors must be a full solid door or half glass door. (Glass at top of door).
  • Paint colour must match the existing complex colour approved by the board.
  • Door and frame must be the same colour.
  • Door knockers are allowed
